KARAN: BiH IS LEADING UNCONSTITUTIONAL LIFE, ITS CONSTITUTION NO LONGER EXISTS

NEVESINJE, NOVEMBER 16 /SRNA/ – Constitutional law professor Siniša Karan pointed to ongoing attempts in BiH to turn anti-Dayton arrangements into Dayton ones, assessing that BiH is living an unconstitutional existence and that its constitution effectively no longer exists.

Karan stated that BiH has not simply drifted away from Dayton, but has moved so far from it that there is now a real version and a non-existent version. “All around the world there is always a gap between what is normative and what is real, but when that gap reaches this scale, you can conclude that the Constitution no longer exists. Today, we are living in an unconstitutional situation, in an unconstitutional country,” Karan told reporters in Nevesinje. He noted that from the perspective of international law, it can be said that the Dayton Agreement has been violated as an international treaty because the other side breached it. “In that sense, these are extremely dangerous tendencies. We will not accept anything that is anti-Dayton, but in such a situation, we will be forced to choose once again—either the principle of self-determination, the same way Republika Srpska was created, or an agreement to return to the original Dayton, or a new path,” Karan concluded.
